LEGAL PROTECTION FOR HOLDERS OF PROPERTY RIGHTS CERTIFICATES WHO SUFFER LOSSES DUE TO THE ISSUANCE OF DUPLICATE CERTIFICATES BY THE LAND OFFICE

Abstract

This research is motivated by the continued occurrence of duplicate certificate issuance, which creates legal uncertainty for holders of Ownership Rights Certificates. This research aims to analyze the forms of legal protection available to holders of Ownership Rights Certificates who suffer losses due to the issuance of duplicate certificates, as well as the responsibility of the Land Office for the losses incurred. The research method employed is normative legal research using a statutory approach and a conceptual approach, utilizing primary, secondary, and tertiary legal materials analyzed qualitatively. The results of the research indicate that legal protection is provided through preventive and repressive measures, while the responsibility of the Land Office is manifested through the cancellation of certificates containing administrative defects, the implementation of court decisions, and legal accountability where errors or maladministration are proven to have occurred. However, the practice of issuing duplicate certificates still indicates weaknesses in land administration. Therefore, improvements in accuracy, supervision, and integration of land data are necessary to ensure legal certainty for holders of land rights.
